A man allegedly tried to rent a home he didn’t own and accepted money from a victim as a deposit.

Antonio Garcia, 36, was charged with third-degree theft and third-degree fraud.

Garcia had reportedly told a man that he could rent a home on Jennings Street in Sioux City but was unable to show the home due to it being cleaned, according to court documents.

Garcia told the victim that he would nee a deposit and met four times in July 2018 to exchange cash deposits totaling $700, with the intention of moving in on August 1, 2018.

The victim tried to text Garcia multiple times without getting any responses.

The victim then went to the home. He learned someone was already living there and that Garcia didn’t actually own it.

Garcia reportedly told police he took the money but had intended to return it. Court documents said that victim had the money returned.

Garcia is being held in the Woodbury County Jail on a bond of $6,000. He is also being held for the State of Nebraska.
