Jefferson Cop sentenced to probation for pointing gun at man during after-hours party

Man pleaded no contest to two charges in connection to April incident

Elk Point, S.D. - A 38-year-old Jefferson police officer currently on unpaid leave has pleaded no contest to two charges in connection to an incident back in April.

According to court documents Melvin "Dan" Engel Jr. pleaded no contest to DUI and simple assault on June 15th. As part of his plea agreement, a third charge of possession of a firearm while intoxicated was dismissed.

Engel will be required to serve two days in jail with 35 days suspended and be placed on unsupervised probation for 11 months. He was also granted a suspended imposition which means that if he completes his probation record of his arrest will be sealed. Engel will be required to pay $1,300 in fines along with $218 in court costs. 

The charges stem from an incident that occurred in the early morning hours of April 1st at a residence in Jefferson. Witnesses to the incident say the incident occurred at an after-bar party while Engel was off-duty and attending the party as a guest. During the incident Engel pulled out a .40 caliber pistol and pointed it at a man's face. He then left the party before police could arrive. Court documents say that Engel was intoxicated at the time of the incident.

Engel is scheduled to report for his 2 day jail sentence on June 21st at 7:00 A.M. The Jefferson City Council is scheduled to meet on July 3rd, where his employment with the city is expected to be discussed.
